Paycheck Loans
my ex-fiance was hit with some sort of lean againts her paycheck which seems to have come out of nowhere but I believed they had to take you to court before they can do that? Is that probable? This is in th state of California by the way. Any person with this very same expertise or legal encounter know or have answers?

No they don’t need to have a court order for student loans. My son was garnished and all his tax returned confiscated for student loans.

AS a rule, they demand a court action if your fiance ignored a court summons, it could have been applied as a default judgement. Also in some cases, you can agree in advance to accept garnishment in case of default.

    The only one I can think of that can attach your paycheck, without a court action, is Uncle Sam. If you got a federal student loan, then yes they can attach.

    If these are government backed student loans, then the government will just take the money as they please.
